Tenon should get out the cake and candles. It will soon be 1 year from the first announcement that this somewhat vaporous product (it's more than vaporware, but not much) was announced as "in the offing". Here is my catalog of official announcements made in this forum and by email:

18 October 2001: "An Xtools 1.1 is in the offing. It will conform to XFree86 4.1 and address various shortcomings, including improving the display engine.

16 January 2002: "Sorry for the lack of Tenon activity on this board. We have suffered a major network outage because of our ISP. After co-locating our server I have not been able to log in to post replies.

Anyway,
I want to assure all users here that a 1.1 update is forthcoming. The latest version of XFree86 has been compiled along with a complete set of libGLU tools.

Our developers have been slowed down by the network outage as well. Xtools is NOT a dead product. We are working hard to address all of the issues of the previous version. We do not want to release it before these bugs are worked out. Please stay tuned for more information. --Stephie"

To his credit, Erik is the first person who has not used the word "soon" or one of its synonyms. I'll also bake a cake, on the 19th it will be exactly 2 years since I purchased an Xtools license. Polite comments are not possible.

Actually I think it has been more than a year. But no matter. I once suggested we consider a class action suit. I re-suggest this. The goal of this suit should be simple:

1) Refund our payments for xtools

or

2) We gain ownership of all xtools source code and officially/legally donate it to the xfree86/xonx/oroborosx people for incorporation into the latest releases (if anything is useful).

There is no doubt that Tenon would lose such a suit since their user agreement/sales contract or whatever you call it clearly states that we will receive a CD and manual in X amount of time, and it was never received. This goes beyond any implied warranties regarding shipping functional software.

What we need to assess is how many xtools users will join and then discuss this issue with lawyers and the xfree86 people

How many people are needed for a class
action? Do they have to be US citicens?

You'd have to get the lawyer to work for free... on the other hand, the fact that it is still posted as a product on the Tenon website is really nasty for possible people buying a copy - hopefully they are researching and finding that there are other alternatives and getting those instead since we are not getting anything here...

the crazy thing is that they don't seem to mind/notice/care (???) that there is so much negative feeling toward them at this point.

I really feel shafted, and I will certainly think twice before purchasing their stuff again. It's quite absurd.

As I've said before, i really think tenon has decided the incredible energy of the xdarwin team is just too much to compete with. when matlab announced its return to mac OS they were originally going to use xtools but ended up with xdarwin. once xdarwin gets hardware accel openGL, and they will, it will be awfully hard for an expensive commercial product to compete - so scarce resources in a small company must be deployed elsewhere. i just wish they'd come out and say it.
